Terms of Service

By accessing or using Mused ("the Platform"), operated at musedart.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. We reserve the right to update these Terms at any time, and your continued use constitutes acceptance of any changes.

Mused is a commission management platform for digital artists. The Platform provides tools for managing client commissions, including intake forms, AI-powered pricing suggestions, milestone-based payments, revision tracking, and file delivery. Mused facilitates transactions between artists and clients but is not a party to those transactions.

To use Mused, you must:

• Be at least 13 years of age (or the minimum age in your jurisdiction)
• Register using a valid Google account via OAuth
• Provide accurate and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

As an artist using Mused, you agree to:

• Deliver commissioned work as agreed upon with clients
• Communicate honestly about timelines, pricing, and deliverables
• Only upload artwork and content you have the right to use
• Not use the Platform for any unlawful purpose
• Handle disputes with clients in good faith
• Comply with all applicable laws and regulations, including tax obligations

As a client commissioning work through Mused, you agree to:

• Provide clear and accurate commission briefs
• Make payments on time as outlined in milestone agreements
• Respect the artist's creative process and revision limits
• Not use commissioned work beyond the scope agreed upon
• Not dispute legitimate charges through your payment provider without first attempting resolution through the Platform

Mused processes payments through Stripe. By using payment features:

• Platform Fee: Mused charges a platform fee on each transaction. The fee varies by subscription tier (5% for Free tier, 2% for Pro tier). This fee is deducted from the artist's payout.
• Stripe Fees: Standard Stripe processing fees apply in addition to the platform fee. These are set by Stripe and are subject to change.
• Subscription Fees: Pro tier subscriptions are billed monthly. You may cancel at any time, and your subscription will remain active until the end of the billing period.
• Refunds: Refund policies are determined between the artist and client. Mused may facilitate refunds but is not obligated to issue them.

Regarding ownership and rights:

• Your Content: You retain all rights to artwork, text, and other content you upload to Mused. By uploading, you grant us a limited license to display, store, and transmit your content as necessary to operate the Platform.
• Commission Work: Intellectual property rights for commissioned work are determined by the agreement between the artist and client. Mused does not claim ownership of commissioned work.
• Platform Content: The Mused name, logo, and Platform design are owned by us. You may not use our branding without permission.

Mused uses artificial intelligence for features such as pricing suggestions, chatbot assistance, and content generation. AI-generated outputs are provided as suggestions only and should not be relied upon as professional financial or legal advice. You acknowledge that AI outputs may be inaccurate and that you are responsible for reviewing and adjusting any AI-generated content before use.

You may not use Mused to:

• Upload or distribute illegal, harmful, or infringing content
• Engage in fraud, scams, or deceptive practices
• Harass, threaten, or abuse other users
• Attempt to access other users' accounts or private data
• Interfere with the Platform's operation or security
• Scrape, crawl, or use automated tools to extract data
• Circumvent payment systems or platform fees
• Generate or distribute content depicting minors in harmful contexts

Mused provides tools for artists and clients to communicate and resolve disputes. However, Mused is not responsible for mediating or resolving disputes between users. If a dispute cannot be resolved between parties, users may seek resolution through appropriate legal channels. Mused may provide timestamped evidence logs to assist in dispute resolution.

Mused is provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, Mused shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid to Mused in the twelve months preceding the claim.

You agree to indemnify and hold harmless Mused, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Receive repeated complaints from other users
• Remain inactive for an extended period

You may delete your account at any time through the Platform settings. Upon deletion, your data will be removed in accordance with our Privacy Policy. Pending transactions and payouts will be processed before account closure.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
